Website Design & Development Packages for Europe

Welcome to Fossens Consulting. By subscribing to our website development packages, you client agree to be bound by the following terms and conditions. Please read them carefully.

1. Agreement Duration

• The Client agrees to a minimum contract term of six (6) months from the date of the website going live or from the start date specified in the signed agreement, whichever comes first.

2. Payment Terms

• Payment for the website development package is due according to the payment schedule outlined in the proposal or agreement. Failure to make timely payments may result in suspension of services.

3. Scope of Work

• The scope of work for the website development package is as described in the proposal or service agreement. Any additional features, pages, or significant changes requested by the Client outside of the initial scope may be subject to additional charges.

4. Source Code and Intellectual Property

• All original source code and related intellectual property developed for the Client’s website remain the property of Fossens Consulting until the completion of the six (6) month contract term. Upon completion of the contract term and full payment of all fees, ownership of the website source code will be transferred to the Client.
• The source code and any proprietary tools or libraries used in the development of the website will not be released to the Client or any third party before the completion of the six (6) month contract term.

5. Website Management and Administration

• The Client will be granted limited access to the website’s content management system (CMS) for the purpose of updating and adding content. Full administrative access to the website, including the ability to install plugins, change themes, or alter the website’s structure, will only be granted after the six (6) month contract term has been completed.

6. Support and Maintenance

• Fossens Consulting will provide ongoing support and maintenance services as specified in the website development package. This includes regular updates to the CMS, plugins, and security patches as necessary.
• Comprehensive support and maintenance details, including any limitations and response times, are outlined in the proposal or service agreement.

7. Cancellation

• Should the Client wish to cancel the agreement before the completion of the six (6) month term, the Client will be responsible for the payment of any outstanding fees for work completed up to the date of cancellation. A cancellation fee may also apply as specified in the agreement.

8. Liability and Indemnity

• Fossens Consulting will not be liable for any indirect, incidental, or consequential damages resulting from the provision of services under this agreement.
• The Client agrees to indemnify and hold harmless Fossens Consulting from any claims, damages, or expenses resulting from the Client’s use of the website.

9. Changes to Terms and Conditions

• Fossens Consulting reserves the right to modify these terms and conditions at any time. The Client will be notified of any significant changes.
